Before breaking ground on a
commercial development, there's a question that can stop a project cold if it's
not answered early: Does this site contain wetlands?
Wetlands aren't always obvious.
They don't always look like marshes or swamps. In the Southeast, across
Georgia, Florida, North Carolina, and South Carolina, wetlands can appear as
seemingly dry areas with certain soil characteristics, subtle drainage patterns,
or vegetation that signals saturation just below the surface. Identifying them
accurately is the job of a wetland delineation.
This post explains what a wetland delineation is, how the process works, when one is required, and what the results mean for your project's permitting and development timeline.
What Is a Wetland Delineation?
A wetland delineation is a field
investigation that identifies the boundaries of jurisdictional wetlands on a
specific parcel. The term "delineation" refers to the act of
precisely mapping those boundaries, drawing the line between wetland and
upland that determines what portion of a site falls under federal and state
regulatory jurisdiction.
Wetland delineations are
conducted by qualified environmental scientists under the framework established
by the U.S. Army Corps of Engineers (USACE). The standard methodology is the
1987 Corps of Engineers Wetland Delineation Manual, supplemented by regional
supplements for areas like the Atlantic and Gulf Coastal Plain, which covers
most of NOVA's service territory in Georgia and Florida.
The results of a delineation directly affect what you can build, where you can build it, and what permits you need to obtain before construction begins. It's one of the most consequential early-stage investigations in environmental due diligence for commercial development.
The Three-Parameter Method: How Wetlands Are Identified
Under the USACE methodology, a location must exhibit all three of the following parameters to be classified as a jurisdictional wetland:

The presence of all three
parameters, hydrology, hydrophytic vegetation, and hydric soils, must be
documented at each sample point during the field investigation. If any one
parameter is absent, that area is classified as upland and falls outside wetland
jurisdiction.
This is why professional wetland delineations require trained scientists, not simply a review of aerial maps or web-based tools. The USFWS National Wetlands Inventory (NWI) maps and the NRCS Web Soil Survey are useful starting points, but they cannot substitute for a boots-on-the-ground field investigation and are not accepted by regulators as a substitute for a formal delineation.
When Is a Wetland Delineation Required?
A wetland delineation is not
always legally mandated, but it is almost always necessary in practice before a commercial development project can proceed. Specifically, one is required or
strongly advised when:
- You are applying for a Section 404 permit from the USACE to fill, dredge, or discharge material into waters of the United States, which includes wetlands
- Your site plan shows grading, fill, or infrastructure within or adjacent to areas that may contain wetlands, streams, or other jurisdictional waters
- A lender, title company, or investor requires it as part of environmental due diligence prior to financing or acquisition
- State or local permits are needed that reference USACE jurisdictional determinations, including state-level environmental resource permits in Florida and coastal development approvals in the Carolinas
- You are conducting a Phase I Environmental Site Assessment that flags potential wetland constraints as a recognized environmental condition
The practical answer for most commercial developers: commission a wetland delineation before you finalize your site plan. Discovering that a portion of your proposed building footprint, parking area, or stormwater pond overlaps a jurisdictional wetland after plans are drawn is expensive. Discovering it before is a planning input.
How the Wetland Delineation Process Works
Step 1: Desktop Review
Before field work begins, the
environmental scientist reviews available data, NWI maps, NRCS soil surveys,
LiDAR topography, historical aerial photography, FEMA flood zone maps, and
prior reports. This desktop review identifies potential wetland areas and informs where field sampling should be focused.
Step 2: Field Investigation
The scientist visits the site
and evaluates sample points across areas of potential wetland occurrence. At
each sample point, they document vegetation species and wetland indicator
status, excavate soil pits to examine soil color, texture, and redoximorphic
features, and record hydrologic indicators such as watermarks, drainage
patterns, saturation depth, and oxidized root channels.
Step 3: Boundary Flagging
Where the three-parameter
threshold is met, the scientist flags the wetland boundary in the field using
survey flagging. The transition between wetland and upland is often a gradual
gradient; experienced delineators use professional judgment to establish a
defensible, consistent boundary line that reflects USACE methodology.
Step 4: Surveying and Mapping
Flag locations are typically
surveyed by a licensed land surveyor and plotted on a site map showing the
wetland boundaries relative to property lines, proposed improvements, and other
site features. This surveyed wetland delineation map becomes the basis for environmental permit applications and
regulatory review.
Step 5: Jurisdictional Determination (JD)
Once the delineation is complete, the USACE may be asked to issue an Approved Jurisdictional Determination (AJD), a formal agency decision confirming which site features are subject to Section 404 jurisdiction. An AJD is valid for five years. Without one, the delineation is the applicant's determination, which USACE can challenge during the permitting review. Most developers and lenders prefer an AJD for certainty.
Wetland Delineation in the Southeast: What Makes It Different

Several factors make Southeast
delineations more complex than the national standard:
- Regional supplements apply. The Atlantic and Gulf Coastal Plain Regional Supplement governs delineations across most of NOVA's service area, with specific guidance on problematic hydric soils common to the region, including soils that appear dry at the surface but have near-surface saturation indicators.
- Florida has a parallel state system. In addition to federal USACE jurisdiction, Florida's Environmental Resource Permit (ERP) program, administered by water management districts, uses a separate state wetland definition and delineation methodology. Sites in Florida often require a dual delineation, one under federal methodology and one under state methodology, to support both federal and state permit applications.
- Seasonal timing matters. The growing season window, groundwater table elevation, and vegetation phenology all vary by subregion. A delineation conducted during drought conditions may yield different results than one performed after a wet season. Experienced regional scientists understand how to document and defend findings across seasonal conditions.
- Coastal and riparian systems are complex. Tidal wetlands in Charleston and the North Carolina coast, bottomland hardwood systems in Georgia's river corridors, and isolated wetlands in Florida's flatwoods all require familiarity with region-specific hydrology and vegetation communities that don't come from a manual alone.
What Happens After a Wetland Delineation?
The delineation report and
surveyed boundary map are the starting point, not the finish line. Depending on
what the investigation finds, the next steps may include:
- No further action: If no jurisdictional wetlands are present, the site is clear of USACE Section 404 jurisdiction. The delineation report documents this finding and supports permit applications or due diligence files.
- Permit avoidance and minimization: If wetlands are present, the site plan may be redesigned to avoid impacts entirely or minimize the footprint of fill in jurisdictional areas. Avoiding wetlands eliminates the need for permits and associated timelines.
- Section 404 Nationwide Permit: Minor wetland impacts (typically under one-half acre) may qualify for coverage under a USACE Nationwide Permit, a streamlined general permit that can be authorized in weeks rather than months.
- Individual Permit: Larger or more sensitive impacts require an Individual Permit, a full public notice and review process that can take six months to several years, depending on agency workload and project complexity.
- Mitigation: Permitted wetland impacts must be offset through mitigation, typically the purchase of mitigation bank credits, in-lieu fee payments, or permittee-responsible mitigation. Mitigation requirements are proportional to impact acreage, wetland type, and regional mitigation ratios.
